1. General
1.1. Terms and conditions of Kaloya Dermatech Ltd. apply to every product purchased through us. This is a web portal which is owned and managed by Kaloya Dermatech Ltd. - a Canadian Incorporated Company.

1.2. It is advisable that the client must read and understand carefully the terms and conditions of purchase before buying our product offline/online. If any purchase is made through us (Online/offline), it implies that you agree to the terms and accept to be legally bound by them. In addition to this, the client shall also be covered under the purview of the terms of use of the website or any other additional terms of service that are applicable with the purchase of the product. In case any conflict/interest/discrepancy appear between the terms & client, it shall yield kaloya dermatech ltd. As the decisive authority in the context of that sale.

1.3. If the purchase and supply terms of our company are not suitable to the client and he/she disagrees with them, please do not access the website for any transaction as it shall be mutually suitable to both of us.

2.1. Kaloya Dermatech Ltd. is a platform for sale of Laser Hair Removal Equipment. As soon as the sale transaction takes place, the product of the company shall be provided to the client in due period.

2.2. Kaloya Dermatech Ltd. holds the sole rights to its product sale and services related to it. It can, therefore, terminate, modify or change any service at any time, without prior notice. Moreover, Kaloya Dermatech Ltd. may add, alter, delete or modify the processes, procedures, conditions or modes applicable to purchase at any time. Kaloya Dermatech Ltd. shall not be liable or answerable to the client or any third party for any change, modification, closure or suspension of any aspect of the services.

3. Product
3.1. All our products shall be shipped; as per the company's policy which is under the discretion of Kaloya Dermatech Ltd. and may be changed as and when required.

3.2. Kaloya Dermatech Ltd. has a clear and specific policy for any damaged product. If in case a damaged product is received, the delivery personnel should be notified immediately. If in case, the damage is observed later, Kaloya Dermatech Ltd. can be notified through our Customer Care Number or kaloyadermatech.com. Customer's satisfaction is the primary policy of our Company. The damage assessment shall take necessary days and it is assured that an optimum solution shall be given. The product shall be replaced or other necessary corrective measures shall be considered to fix the issue.

4. Services
4.1. It is up to the client that he/she utilizes the product at his will. Kaloya Dermatech Ltd. is not liable for any discrepancy and management in this regard.

4.2. It shall be understood that the client is of legal age to undergo a binding contract with our Company and has not been barred by law of the land from receiving our services.

4.3. It shall be the responsibility of the client to ensure the complete payment of the purchased product from Kaloya Dermatech Ltd. The Company shall not be responsible for any deficiency thereof.

4.4. Kaloya Dermatech Ltd. hereby reserves the right to withdraw and/ or alter any of the terms and conditions anytime without prior notice, at its sole discretion.

5. Pricing Information
5.1. All information regarding the pricing of the product shall be disclosed to the client at the time of purchase itself as it carries offers, discounts, schemes etc. at intervals of time period.

5.2. Kaloya Dermatech Ltd. is interested in providing best price for its product. However, Kaloya Dermatech Ltd. shall not be liable to make these prices to be the lowest in the city, region, territory or geographical domain. Prices and availability of the product are subject to change from time to time without any prior notice; and any successive liability in this regard.

6. Credit Card Details
In case the payment of the product is made through Credit/Debit cards, the client shall be required to furnish credit or debit card details to the approved payment gateways. Moreover, along with this, the clients shall furnish correct and accurate credit / debit card details to the approved payment gateways to avail the Services of the Company. The clients should ensure that they use only those credit / debit cards that are lawfully owned by them. The information given by the client shall not be shared or utilized with any third party unless it is absolutely essential for any legal, quasi-legal, regulation, court proceeding or court order. It is the sole responsibility of the client towards the confidentiality and security of the credit / debit card details. Kaloya Dermatech Ltd. is not liable for any consequences that may occur because of the unauthorized use of the client’s credit / debit card.

7. Delivery of the Product
Details of the shipping address including pin code furnished in the purchase order shall be verified with the database of Kaloya Dermatech Ltd. before the payment of the purchase is made. If the order cannot be serviced or the area is not covered at the end of the Company, we shall request you to provide alternate shipping address which we expect to have on our delivery list. If a dispute generates related to the shipment of the product for the particular area, Kaloya Dermatech Ltd. holds no responsibility for the non-delivery of the product. Transactions of the product can be made from anywhere in the world.
In case of multiple orders for the product in one transaction, then our policy is to ship all products together in one go. But in some cases, this shall not be possible.

8. Return Policy
8.1. In case of a defective/ damaged product or a product which does not confirm to the original specifications is delivered; the client is requested to contact the Customer Service Section of the Company within 48 hours from the time product is delivered.

8.2. After confirming the complaint for authenticity and after inspecting the nature of the complaint, Kaloya Dermatech Ltd. will offer replacement. If it is found that the complaint is non-genuine, Kaloya Dermatech Ltd. has the right to take legal action and the client shall be responsible for bearing all costs incurred by Kaloya Dermatech Ltd. in this regard.

8.3. All deposits and securities are non-refundable irrespective of any situation. As the given amount is to offset company and labor time expended.

9. Warranties and Claims
Please take note of standard warranties and conditions regarding the usage of the product. Kaloya Dermatech Ltd. is not liable for any claim in case of -

(a) If the product is not used in accordance to the above warranties.
(b) If the conditions of usage are not followed.

10. Indemnification and Limitation of Liability
10.1. It is agreeable on your behalf to indemnify (compensate for harm or loss), defend and hold harmless Kaloya Dermatech Ltd. from and against any, some, in parts and all losses, claims, liabilities, demands, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) instigated against or incurred by Kaloya Dermatech Ltd. that result from, arise out of, or may be payable by virtue of, any breach of any representation, covenant, warranty, or agreement made or obligation to be performed by yourself pursuant to these Supply Terms or any Additional Terms applicable to the purchase of the product.

10.2. In no circumstance shall Kaloya Dermatech Ltd., its directors, officers, staff, employees be liable to the client for any incidental, special, indirect, consequential or punitive damages whatsoever, including those which result from loss of use, data or profits, whether or not foreseeable or whether or not Kaloya Dermatech Ltd. has been advised of the possibility of such damages, or whether based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim which may arise out of or in connection with client’s purchase of the product herein.

11. Governing Law
11.1. The Supply Terms mentioned above and the relationship between the client and Kaloya Dermatech Ltd. are applicable without reference to conflict of laws principles.

11.2. All claims, differences and disputes that may arise under or in connection with or concerning the Terms and Conditions of Offer For Sale or any other transactions that take place or are entered with us or the relationship between the client and Kaloya Dermatech Ltd. shall be under the purview and exclusive jurisdiction of the State Court and You hereby accede to and accept the jurisdiction of the court.

12. About the Treatment with the Laser Hair Removal Machine - KDT 750 IPL
12.1. It is asserted by Kaloya Dermatech Ltd. that Laser Hair Removal Treatment is not a permanent treatment and it is a semi-treatment.

12.2. This treatment ensures that it reduces hair growth on a long-term basis.

12.3. It should be clearly understood that it does not take off the hair forever hundred percent, but it can drastically reduce hair growth, that which is most required.

12.4. Our Laser Hair Removal Machine KDT 750 IPL offers a semi-permanent hair removal; which means that it is capable of giving you a drastic reduction of hair growth.

12.5. It is to be clearly understood that the Machine is more effective on those with dark hair against fair skin while it is less effective on fine, peach fuzz hair, blond, reddish or grey hair and Kaloya Dermatech Ltd. is not responsible for this as it is a fact that laser lights are attracted to dark hair most. Those with fairer hair or such hair shall have to go for more sessions to get better results.

12.6. Kaloya Dermatech Ltd. is not responsible for any kind of harm or damage if the Machine is used for genitals, eyebrows or men’s facial hair.

13. About the Side-Effects
13.1. Kaloya Dermatech Ltd. clearly indicates that the Company is not responsible of any kind of side effects by the use of its Machine KDT 750 IPL.

Kaloya Dermatech Ltd. shall not be responsible for any side-effects such as:

Temporarily, the skin pigment may change by getting lighter or darker in color due to exposure of light.

Short-term irritation may occur such as swelling, itching, redness or tingling.

If the Machine is not used properly, side-effects may occur such as scarring, burning, crusting or blistering.

13.2 Kaloya Dermatech Ltd. is not liable for any kind of side-effects if the buyer makes the Laser go over an area for more than prescribed.

13.3. The few side-effects that appear after the use of the Machine are minor and temporary.

13.4. Kaloya Dermatech Ltd. is not responsible for lasting side-effects.

13.5. Kaloya Dermatech Ltd. clearly indicates that Laser Hair Removal damages the follicles of the targeted hair. As the body reacts to this, you may experience irritation, redness, slight swelling or the skin may tingle or feel tender. But all these symptoms are short-lived and Kaloya Dermatech Ltd. is not liable if they prolong.

13.6. If you experience skin crusting in the affected area, it is typically a minor issue and Kaloya Dermatech Ltd. is not responsible for any scabbing or scarring after this.

13.7. Kaloya Dermatech Ltd. is not liable for any color changes to the treated area of the skin. These skin color changes tend to fade away over time and the skin returns to normal, but if this does not happen, Kaloya Dermatech Ltd. is not responsible.

13.8. It is essential that you wear protective eye equipment while using the Machine on your face. Kaloya Dermatech Ltd. is not responsible if you do not do so and which may cause any kind of eye injury.

13.9. In case any kind of skin infection occurs, the customer should report immediately to a dermatologist, and if you do not do so, Kaloya Dermatech Ltd. is not held responsible.

14. During Pregnancy Period
Kaloya Dermatech Ltd. clearly does not recommend the use of our Machine KDT 750 IPL during pregnancy and the company is not liable for any kind of harm if the customer uses our Machine during such time.

15. Myths
15.1. The use of our Laser Hair Removal Machine KDT 750 IPL does not cause cancer as the lasers are specially designed to pass through skin cells and target only hair follicles deep within the skin. The lasers produce only a small amount of radiation which is not harmful.

15.2. The use of our Laser Hair Removal Machine KDT 750 IPL does not cause infertility as the lasers only penetrate the skin and do not reach or affect any other organs.

16. Safety
16.1. Kaloya Dermatech Ltd. assures that its KDT 750 IPL Machine is safe and effective only when it is performed correctly.

16.4. Kaloya Dermatech Ltd. assures that KDT 750 IPL is an ergonomic product as it is easy to install and maintain.
